The Equation Agency LLC provides technology consulting services including website design and development, custom applications, CRM systems, business automation, artificial intelligence implementations, and technical SEO. Specific terms for individual engagements are governed by separate project agreements or statements of work.
3. Use of the Site
You agree to use this Site only for lawful purposes. You may not:
- Use the Site in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any portion of the Site
- Transmit any material that is harmful, offensive, or disruptive
- Copy, reproduce, or distribute Site content without written permission
4. Intellectual Property

Client deliverables — including websites, applications, and custom code we build for you — are governed by your individual project agreement, which specifies IP ownership upon final payment.
5. Consultations and Inquiries
Submitting a contact form or booking a consultation does not create a client relationship or obligate either party to proceed with any engagement. A client relationship is established only upon execution of a written project agreement and receipt of a deposit.
6. Technology Assessment — Non-Refundable Fee
The Technology Assessment is a paid diagnostic engagement. By booking a Technology Assessment, you agree to the following:
- Non-refundable: The Technology Assessment fee is non-refundable once the assessment process has commenced. Work begins upon receipt of payment.
- Project credit: If you proceed to a full project engagement with The Equation Agency LLC within 90 days of the assessment delivery, 100% of the Technology Assessment fee will be credited toward your project investment.
- Deliverable: The fee covers a complete audit of your current technology stack, identification of gaps and opportunities, and a written roadmap document delivered to you.
- Scope: The Technology Assessment does not include implementation, development, or any ongoing service. It is a standalone advisory deliverable.
- No guarantee of engagement: Completion of a Technology Assessment does not obligate either party to proceed with a project.
7. Pricing
Prices referenced on this Site are starting points and estimates only. Final pricing is determined after project scoping and is set forth in a written agreement. All prices are in USD.
A deposit is required to commence all projects. Deposit amounts and payment schedules are defined in each project agreement. All deposits are non-refundable unless otherwise stated in writing. We reserve the right to pause or terminate any engagement if payment obligations are not met.
8. Disclaimer of Warranties
This Site is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, The Equation Agency LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
10. No Guarantee of Results
We do not guarantee specific search engine rankings, revenue outcomes, lead volumes, or any other business results. Digital marketing and technology projects involve variables outside our control, including search engine algorithm changes, market conditions, and third-party platform changes. Any performance benchmarks discussed are goals, not guarantees.

12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Miami-Dade County, Florida.
